NEW DELHI: The drill for appointing Justice DY Chandrachud, the senior-most judge of the Supreme Court, as the next CJI has begun with law minister Kiren Rijiju writing to CJI UU Lalit to name his successor. Justice Lalit retires on November 8 after completing his tenure of 74 days. If appointed the next CJI, Justice Chandrachud will get a tenure of two years, till November 9, 2024.
Though a routine exercise, the law ministry put out a tweet on its official handle in what was seen as an unusual step. It referred to the Memorandum of Procedure (MoP) for appointment of CJI and SC judges as the basis for the minister writing to the CJI seeking his recommendation. As per the MoP, the seniormost judge of SC is recommended for the next CJI.
“As per the MoP on appointment of CJI and SC judges, today the minister of law and justice sent a letter to the CJI for sending his recommendations for appointment of his successor,” the ministry said in a tweet.
The letter by the law minister to the CJI, initiating the formal process of appointment of his successor, restricts the powers of the incumbent to convene meeting of the collegium to select judges for the SC and high courts. There are currently 29 judges (including the CJI) who comprise the SC. The maximum possible strength of SC if 34.
